Ramzan FM in breach of short term licence

Restricted Service Licence, Ramzan FM, has been found in breach of its licence after operating in Oldham last year.

The service broadcast from June 28th to July 29th 2014 during which it had several appeals for listeners to donate money to a particular organisation.

However, the licence holder did not reply to Ofcom when asked for details of this organisation and confirmation of its charitable status. Ofcom considered the matter raised issues warranting investigation under Condition 9(1) of the Licensee’s S-RSL which states that:

“The Licensee shall furnish to Ofcom in such manner and at such times as Ofcom may reasonably require such documents, accounts, returns, estimates, reports, notices or other information as Ofcom may require for the purpose of exercising the functions assigned to it”.

The Licensee did not respond to Ofcom’s requests for its comments so is therefore recording a breach of Condition 9(1).

The breach will be held on record and may be taken into account should any future application for a licence to broadcast be received from the Licensee.
