Ofcom has found Radio Ramadan, an RSL service in Huddersfield, in breach of its licence condition for failing to provide a recording of transmission.
The regulator asked for a copy of a programme from 22 July 2014, after a listener complained that particular comments that were likely to cause religious offence.
The complaintant said comments were made by presenters concerning a forthcoming community radio service in the area.
Ofcom wrote to the Licensee to request a recording of the relevant content. The Licensee did not provide the recording by the deadline specified, and after a reminder.
Subsequently, the Licensee acknowledged the recording request and said that it would provide the material by a specified date. However, it did not do so.
Under the Communications Act 2003, Ofcom has a duty to ensure that in each broadcaster’s licence there are conditions requiring the licensee to retain recordings of each programme broadcast, in a specified form and for a specific period after broadcast, and to comply with any request to produce such recordings issued by Ofcom.
The station made no comment.
